The rules for using the Maketools platform, for visitors, players, members and organisation administrators.

1. Purpose

These terms of use (the "Terms of Use") set out the rules for accessing and using the Maketools platform (the "Platform"), published by MAKETOOLS SAS, 149 avenue du Maine, 75014 Paris, RCS Paris 990 247 603 ("Maketools", "we").

The Platform offers training games on data and artificial intelligence literacy, which organisations can customise ("fork"), distribute to their teams and measure.

2. Acceptance

You accept the Terms of Use:

  • by creating an account (checkbox on the sign-up form, or sign-up with Google, Microsoft or your organisation's SSO);
  • failing that, by playing a game or browsing the Platform.

If you do not accept the Terms of Use, do not use the Platform. The subscription to a plan by an organisation is also governed by the terms of sale.

3. Definitions

  • User: any person who uses the Platform, with or without an account.
  • Account: a User's personal space, protected by their credentials.
  • Organisation: the space of a company or entity on the Platform, which brings together its members, its games and its reports.
  • Customer: the legal entity or professional who created an Organisation or subscribed to a plan.
  • Member: a User attached to an Organisation, with a role (Owner, Admin, Editor, Analyst or Member).
  • Player: any person who plays a game, with or without an account.
  • Game: a game from the Maketools catalogue.
  • Fork: an Organisation's customised copy of a Game (content, rules, theme, images), published at its own address.
  • Demo: a catalogue Game played without an account, as an anonymous demo.
  • Public game: a Fork deployed with Public visibility, which anyone can play without an account.
  • Private game: a Fork with Organisation or Restricted visibility, reserved for the members the Organisation authorises.
  • Nickname: the optional name a Player without an account chooses to appear on the leaderboard of a Public game.
  • Presenter mode: a game screen intended to be projected during an event or a workshop (QR code to the game, number of players and sessions, leaderboard of the event).
  • Customer Content: the texts, images, colours and settings that an Organisation adds to its Forks, as well as the data it imports (translations, member lists).

4. Access to the Platform

4.1 Intended audience

The Platform is intended for professional or training use. It is restricted to persons aged at least 16.

4.2 Without an account

Catalogue Demos and Organisations' Public games can be played without an account. No personal identifier is then associated with the game session, apart from the Nickname if you choose to enter one (article 4.5).

Each Demo and each Public game opens with a Maketools welcome screen: logo, presentation of the Platform and a QR code to the maketools.ai website. The Organisation cannot remove this screen. The QR code is a mere image of a link: it collects no data.

The content of a Public game is published under the responsibility of the Organisation that edited it; Maketools hosts it (article 7).

4.3 With an account

Some features require an account: joining an Organisation, playing a Fork reserved for its members, forking, editing, deploying, viewing reports. You undertake to:

  • provide accurate information, in particular a valid email address that you use;
  • keep your credentials confidential and not share your Account;
  • enable two-step verification when it is required (managing the security of an organization, named reports, or a rule set by your organization);
  • notify us without delay at charlotte@maketools.ai of any unauthorised use of your Account.

You are responsible for actions carried out from your Account, unless you establish that it was used without your knowledge despite your precautions.

4.4 Sign-in through a third party

If you sign in with Google, Microsoft or your Organisation's identity provider (SSO), that third party authenticates you under its own terms. An Organisation may require SSO for its members: password sign-in is then refused to them.

4.5 Nickname

On a Public game, a Player without an account may choose an optional Nickname. The Nickname is shown on the game's leaderboard and on the Presenter mode screen: it is therefore visible to the whole audience of the game, including on a screen projected in a room.

A Nickname has 2 to 24 characters: letters, digits, spaces and the signs . _ ' -. Coarse or hateful terms from a block list are refused. You undertake to choose an appropriate Nickname, in particular:

  • with no insult, hateful or discriminatory remark, or obscene allusion;
  • without impersonating another person, an organisation or Maketools;
  • with no personal data of a third party (name, email, phone number).

We recommend that you do not use your full name. Maketools reserves the right to remove a Nickname that breaks these rules.

5. Organisations

5.1 Roles and responsibilities

The creator of an Organisation becomes its Owner. They declare that they are authorised to bind the Customer. The Customer, through its Owners and Admins:

  • chooses whom it invites, with which role, and who has access to each of its Forks (public, Organisation, or specific groups and members); by making a Fork public, it makes it accessible to everyone, without an account;
  • decides on the reporting mode (pseudonymised by default, or named) and informs its Players of it; the Platform also displays this information in the game;
  • is responsible for Customer Content and for the use it makes of the reports.

5.2 Data of an Organisation's Players

For game sessions played on an Organisation's Forks, the Customer is the controller of its Players' data and Maketools acts on its behalf, in accordance with the data processing agreement. To exercise your rights over this data, first contact the Organisation concerned.

5.3 Leaving an Organisation

You can leave an Organisation at any time, unless you are its only Owner and it has other members: transfer ownership first.

5.4 Public games and Presenter mode

The Organisation that publishes a Public game is solely responsible for its content towards all its Players, members or not. In particular, it ensures that the game cannot be mistaken for a communication from another organisation.

Presenter mode is open to the same persons as the game (everyone for a Public game). The Organisation, or the person running the event, is responsible for what it projects and where it projects it. The projected leaderboard shows the Nicknames of Players without an account and, for signed-in Players, the label provided by the Organisation's reporting mode; the Organisation informs participants of this.

6. Rules of use

You undertake to use the Platform fairly and lawfully. In particular, it is prohibited:

  • to publish content that is unlawful, defamatory, abusive, discriminatory, violent, pornographic, or that infringes the rights of a third party (copyright, trade mark, image rights, privacy);
  • to publish content that is hateful, that harasses a person or a group, or that incites violence;
  • to use a game for fraud: phishing, scams, requests for passwords, codes or bank details, links to misleading or malicious sites;
  • to encourage Players to disclose personal or confidential information;
  • to publish advertising or unsolicited commercial solicitation;
  • to insert into a Fork personal data of third parties, or sensitive data within the meaning of Article 9 GDPR (health, opinions, origin…), without necessity or legal basis;
  • to circumvent or attempt to circumvent security measures, access controls, plan limits or rate limits;
  • to access data that is not intended for you, in particular that of another Organisation;
  • to introduce malicious software, to disrupt the operation of the Platform or to impose an excessive load on it (load tests, bots, content scraping);
  • to distort scores or leaderboards, for example by sending fabricated game events;
  • to use invitations to send unsolicited messages;
  • to impersonate another person or another organisation, in particular by using its name, logo or visual identity in a game or a Nickname;
  • to choose a Nickname contrary to article 4.5;
  • to send abusive, false or repeated reports;
  • to decompile or disassemble the Platform, outside the cases authorised by Article L. 122-6-1 of the French Intellectual Property Code (Code de la propriété intellectuelle);
  • to resell, rent or make the Platform available to a third party outside the uses provided for by the Customer's plan.

Good-faith vulnerability research is welcome if it complies with our responsible disclosure policy (trust center): do not access other people's data, do not degrade the service and notify us before any publication.

7. Customer Content

7.1 Warranties

The Organisation that publishes Customer Content warrants that it holds the necessary rights (in particular over imported images) and that this content complies with the Terms of Use.

7.2 Licence granted to Maketools

The Customer remains the owner of Customer Content. It grants Maketools, worldwide and for the duration of hosting, a non-exclusive, royalty-free licence to host, reproduce, technically adapt (re-encoding of images, resizing) and display this content, for the sole purpose of providing the Platform to the persons it authorises.

7.3 Reporting

Maketools hosts Customer Content without reviewing it in advance. Anyone, with or without an account, may report a playable game with the Report this game button, choosing a reason:

  • illegal content;
  • fraud (phishing, scam, impersonation);
  • hate, harassment or violence;
  • exposed personal data;
  • other.

They may add a message (2,000 characters at most) and, if they wish to receive a reply, their email address. It is also possible to write to charlotte@maketools.ai, stating the precise address of the content, the reasons why it is unlawful (with the legal provisions concerned if possible), one's name and contact details, and a statement of good faith.

The identity and email of the person reporting are never disclosed to the Organisation.

7.4 Decision and appeal

Maketools moderation examines each report diligently. It may dismiss the report, remove or disable access to manifestly unlawful content, or suspend the game concerned: it can then no longer be played. Maketools notifies its decision to the Organisation's Owners, with its reasons: the ground relied on, the facts concerned, the scope and duration of the measure, and the means of appeal, unless prohibited by law. A person who reported with their email is informed of the outcome.

The Organisation, like the person who reported, may contest the decision by email to charlotte@maketools.ai. Maketools then reviews the decision and communicates the result. These means do not prevent anyone from bringing the matter before the competent court.

8. Maketools intellectual property

The Platform, the Games (rules, original content, illustrations, sounds), the game engine, the code, the documentation and the Maketools brand belong to Maketools or its licensors. Maketools grants you a personal, non-exclusive and non-transferable right to use the Platform in accordance with the Terms of Use, for the duration of your access. No other right is transferred.

If you send us suggestions or feedback, we may use them freely to improve the Platform, without compensation.

9. Educational content

The Games are intended for awareness and training. Their content is scripted; it does not constitute legal, technical or professional advice. Scores and skill summaries measure success in the game: they are neither a certification nor a professional assessment.

10. Personal data

The processing of your personal data is described in the privacy policy. You can export your Account data or delete your Account at any time from the Account → Your data page.

11. Availability and changes

We strive to keep the Platform available at all times, without being able to guarantee it: interruptions may occur for maintenance, updates, incidents or external causes. Where possible, we announce planned maintenance.

The Platform evolves: we may add, change or remove features. A Fork remains attached to the version of the Game on which it was created; updating to a new version is offered to the Organisation, never imposed. The commitments specific to paid plans are set out in the Terms of Sale.

12. Liability

Maketools is bound by an obligation of means (best efforts). It cannot be held liable for:

  • use of the Platform contrary to the Terms of Use;
  • Customer Content, or the use an Organisation makes of its reports;
  • third-party services (identity provider, LMS, email);
  • an interruption due to a cause not attributable to it.

For free use of the Platform, and within the limits permitted by law, Maketools' liability is limited to direct and proven damage. Nothing in the Terms of Use excludes Maketools' liability in the event of gross negligence or wilful misconduct, or in the event of personal injury. Liability towards paying Customers is governed by the Terms of Sale.

13. Suspension and termination

You can delete your Account at any time from Account → Your data. Deletion is immediate and permanent; its effects on Organisations are described in the privacy policy.

Maketools may suspend or close an Account, or a Fork, in the event of a serious breach of the Terms of Use, a risk to the security of the Platform or of other Users, or at the request of an authority; the suspension of a reported game follows article 7.4. Except in an emergency or where required by law, we notify you and invite you to submit your observations. The Customer may likewise withdraw a Member's access to its Organisation.

14. Changes to the Terms of Use

We may change the Terms of Use, for example to follow changes to the Platform or the law. Any significant change is notified to you by email or in the Platform at least 30 days before it takes effect. If you refuse it, you may delete your Account before that date; otherwise, the new version applies. The versions and their dates are listed in the version history.

15. General provisions

  • Partial invalidity: if a clause is held to be void, the other clauses remain applicable.
  • No waiver: failing to rely on a breach does not constitute a waiver of the right to rely on it later.
  • Language: the French version prevails.
  • Governing law: the Terms of Use are governed by French law.
  • Disputes: in the event of a dispute, first write to us to seek an amicable solution. Failing that, and if you are acting as a professional, the Paris Commercial Court (tribunal de commerce de Paris) has sole jurisdiction. If you are a consumer, you may refer the matter free of charge to the consumer mediator [To be completed: name and contact details of the mediator] or to the court having jurisdiction under ordinary law.
